Links between organization
operation and national economic reforms programs in Ukraine
Today the Center is engaged in implementing
two major programs: the program for forming associations of multifamily
buildings owners and the program for private housing management and maintenance.
In order to realize to what extent these programs are consistent with the
national tasks in reforming housing sector, it is necessary to address
certain provisions in the basic state documents relating to this sphere.
The major document establishing national policy
for reforming housing and municipal economy is the National Housing
Policy Concept approved by the Supreme Rada Resolution of June
30, 1995, No.254/95-BP. The document states that the national housing policy
is aimed at creating conditions for the individuals to realize their right
for housing; at increasing housing construction; at improving housing stock
maintenance standards. Housing maintenance is one of the first priorities
for the country's socio-economic development. The need to reform the national
housing policy arises, in particular, from the need to speed up the housing
sector integration into the general system of market economy.
The national housing policy envisages, among other things:
- further privatization of public housing stock,
putting in place housing market and housing economy market structures;
- enhancing the units (buildings) owners' and
users' responsibility for their appropriate use and maintenance;
- formation of multifamily buildings co-owners'
associations (condominiums) aimed at providing adequate housing and attached
territories maintenance.
Individuals (condominiums) can take part in:
managing housing stock so as to protect their economic and social rights
and interests; selecting on the competitive basis structures for housing
construction, maintenance and repair; exercising control over housing and
utilities expenses and pricing.
It is stated in conclusion that the National Housing
Policy Concept provides a foundation for drafting new Housing Code of Ukraine,
other legislative acts which regulate housing relations in the present
socio-economic environment; its provisions shall be also taken into consideration
in the course of designing regional and branch programs for providing public
housing.
In order to promote further realization of the
above-stated Concept, the Strategy for Reforming the National
Housing Policy has been developed in Ukraine under the decision
taken by the Coordination Committee for Reforming the National Housing
Policy attached to the Cabinet of Ministers of Ukraine (protocol No.1 of
August 2, 1996). This document states, in particular, that in order to
expedite Ukrainians' more active involvement in preserving housing stock
it is necessary to accelerate housing privatization, condominium formation
and providing incentives for adequate housing maintenance. Since the standards
of services rendered by the state-run housing maintenance structures are
extremely low, the only right step towards improving service standards
is creating competition in this sector.
The first provision in the Regulations "On
the procedure for forming and operating associations set up by co-owners
for managing, maintaining and using the residential buildings property
in common use" (approved by the Cabinet of Ministers Resolution
No.588 of July 31, 1995) states that forming co-owners' associations for
managing, maintaining and using the residential buildings property in common
use (ancillary units, technical facilities, external improvements, attached
territories, etc.) is mandatory.
In compliance with this Resolution, a joint Decree
No.44/1217 on approving "Standard By-Laws for co-owners' associations
for managing, maintaining and using residential buildings property in common
use" was signed on October 16, 1995 by the State Committee
of Ukraine for Housing and Municipal Economy and the State Property Fund
.
A brief overview of these documents' main provisions
proves that the Center programs are fully consistent not only with the
strategy of housing reforms in Ukraine, but also with specific measures
taken towards their realization.
This provided the chief grounds for signing on
March 27, 1998 the Agreement on Cooperation between the State Committee
for Construction, Architecture and Housing Policy in Ukraine and
the International Non-Governmental Organization "Housing and Municipal
Reform Support Center". The Agreement stipulates, in part, that the
Center shall render practical assistance to the Committee in implementing
the National Housing and Municipal Reforms program, while the Committee,
in its turn, shall act as the chief coordinator for the Center's operation.
Spheres of programs implementation
The Center's programs are implemented along
the following major lines:
- collaboration with the Supreme Rada of Ukraine,
the Cabinet of Ministers, ministries and agencies aimed at expediting housing
reforms and improving effective legal framework in housing and municipal
economy;
- drafting legal and normative acts in conjunction
with the State Committee for Construction, Architecture and Housing Policy
in Ukraine;
- holding seminars for different level executive
officials on the subject of creating favorable local conditions for forming
condominiums and for attracting private housing maintenance companies;
- holding seminars for multifamily buildings residents
on the subject of setting up and operating condominiums;
- preparing, publishing and disseminating publications
on setting up, registering and operating condominiums;
- conducting training sessions for officials involved
in housing maintenance on PMM program (Western experience in real estate
management), restructuring their work to meet current requirements;
- training private companies staff interested
in participating in competitions for housing maintenance;
- holding upgrading and expertise-sharing seminars
for private maintenance companies which have been in business for some
time already;
- preparing, publishing and disseminating methodological
materials on competitive selection of private housing maintenance companies
and publications helpful for private companies already engaged in housing
maintenance.
Programs implementation:
basic results
The Center specialists have done a lot and have accumulated considerable
expertise in implementing housing and municipal reforms in Ukraine since
the beginning of their realization. The Center specialists, in particular:
- have taken part in drafting the Cabinet of
Ministers Resolution No.588 "On approving the Regulations on the procedure
for forming and operating associations set up by co-owners for managing,
maintaining and using residential buildings property in common use";
- have taken part in drafting the Housing Code
of Ukraine, the National Housing Policy Concept, Standard By-Laws for multifamily
buildings co-owners' associations, Regulations on the associations state
registration, other major state documents pertaining to housing and municipal
reforms in Ukraine;
- have developed and submitted to the State Committee
for Construction, Architecture and Housing Policy of Ukraine proposals
for amending the draft of the Civil Code of Ukraine, draft Laws of Ukraine
"On introducing alterations and amendments to the Law of Ukraine "On
privatization of public housing stock" and "On associations of
multifamily buildings co-owners and on condominium associations",
draft Cabinet of Ministers Resolutions "On competitive selection of
housing maintenance and repair companies and their operation", "On
restructuring housing and construction (housing) cooperatives into multifamily
buildings co-owners' associations" and other document drafts. Their
efforts in drafting legal and normative acts, which are indispensable for
successful accomplishment of housing and municipal reforms, are ongoing.;
- under Condo Program have prepared
and held 551 seminars for officials, 561 seminars
for multifamily buildings residents. There have been 277
press publications, 116 TV broadcasts and 68 radio
broadcasts about the relevant issues. Their efforts resulted in forming
1047 condominiums in 150 cities of Ukraine;
- under PMM program have prepared
and held 121 seminar for officials and 29 three-day
training sessions for private companies in 130 cities of
Ukraine. As a result, 120 competitively selected private
companies in 50 cities and towns of Ukraine have already concluded contracts
for maintaining 300,000 units;
- have authored and disseminated all over Ukraine
a great number of recommendations, guides, manuals, training courses, reference
books on the above-stated programs;
- are busy preparing and publishing the National
Housing Sector Program information newsletter "Housing Reform News".
